Lightning Learners – Terms & Conditions

Last updated: 29.10.2026

Welcome to Lightning Learners! We're passionate about helping our pupils become safe, confident and independent drivers.

These Terms & Conditions explain how our driving lessons work, including bookings, payments, cancellations and what you can expect from us.

We aim to be fair, flexible and straightforward. Please take a few minutes to read these terms before starting lessons.

1. About Us

Lightning Learners is operated by Lightning Learners Ltd, a company registered in England and Wales.

Our driving lessons are provided by a qualified, DVSA-approved driving instructor.

By booking driving lessons with us, you agree to these Terms & Conditions, subject to your statutory consumer rights.

For pupils under 18, we ask that a parent or guardian also reads these terms and agrees to any payment arrangements made on the pupil's behalf.

2. Booking Driving Lessons

  • All lessons are subject to instructor availability.

  • Lesson dates, times, duration and collection locations will be agreed in advance.

  • Lessons are normally conducted in our dual-controlled driving school vehicle.

  • The duration of each lesson includes any necessary discussion, demonstration, driving practice and feedback.

  • If you need to change your agreed collection or drop-off location, please let us know in advance. Changes are subject to availability and may affect the lesson time.

  • Regular lesson times will be offered wherever possible, although we cannot guarantee the same time every week.

We will always do our best to provide a reliable and consistent learning experience.

3. Lesson Prices & Payments

  • Our current lesson prices will be confirmed before booking and are available on our website.

  • Payment should be made by the agreed payment method and within the timescale communicated when booking.

  • We may require payment in advance to secure a booking.

  • Any outstanding lesson fees must be settled before further lessons are provided, unless otherwise agreed.

  • We reserve the right to change our lesson prices, but any changes will be communicated in advance and will not affect lessons already paid for at an agreed price.

Any special offers or discounted lesson packages will have their conditions clearly explained before purchase.

4. Our 48-Hour Cancellation Policy

We understand that plans sometimes change. However, when a lesson is booked, that time is reserved especially for you and is unavailable to other pupils.

To keep things fair for everyone, we operate the following cancellation policy.

Cancelling with at least 48 hours' notice

You may cancel or rearrange a lesson without charge, provided we receive at least 48 hours' notice before the scheduled lesson start time.

Cancelling with less than 48 hours' notice

If you cancel, postpone or rearrange a lesson with less than 48 hours' notice, the lesson will normally remain chargeable.

Where we are unable to fill the cancelled appointment, a charge of up to the full booked lesson fee may apply, reflecting the time lost and any costs saved.

We'll always try to help

We appreciate that unexpected circumstances arise.

Whenever a pupil cancels at short notice, we will make reasonable efforts to offer the appointment to another pupil.

  • If we successfully fill the entire appointment at the same value, we will waive the cancellation charge.

  • If we recover part of the lost booking value, we will reduce the cancellation charge accordingly.

  • If the appointment cannot be filled, the lesson fee will normally remain payable, subject to the charge reflecting our genuine loss.

  • We may also waive or reduce charges in exceptional circumstances at our discretion.

We cannot guarantee that a replacement pupil will be available, particularly at short notice.

Illness and emergencies

If you are unwell or have an emergency, please let us know as soon as possible.

We will consider genuine exceptional circumstances sympathetically and individually. However, illness or unforeseen circumstances do not automatically remove the cancellation charge.

How to cancel

Please contact us directly by text message, WhatsApp or email using the contact details we have provided.

The 48-hour period is calculated from the scheduled start of your lesson, including weekends and bank holidays.

For example, if your lesson is booked for Thursday at 3pm, notice must be given by Tuesday at 3pm.

Any applicable cancellation charge will be calculated fairly, taking account of reasonable steps to reduce our loss. We will not charge twice for the same appointment.

This policy does not affect your statutory consumer rights.

5. Missed Lessons & Late Arrivals

Please be ready at your agreed collection point at the scheduled lesson time.

  • If you are running late, please contact us as soon as possible.

  • Where possible, we will still conduct the lesson, although it may need to finish at the originally agreed time to avoid delaying other pupils.

  • If you do not attend your lesson, or are unavailable when we arrive, the appointment will normally be chargeable under our cancellation policy.

  • If you decide to finish a lesson early, the agreed lesson fee will normally still apply unless there is a good reason for a refund or adjustment.

We understand that occasional delays happen and will always try to act reasonably.

6. If We Need to Cancel or Rearrange a Lesson

We aim to provide every lesson as agreed. Occasionally, circumstances outside our control may mean a lesson needs to be changed or cancelled.

Examples include instructor illness, vehicle breakdown, severe weather, unsafe road conditions or emergencies.

If we need to cancel a lesson:

  • We will contact you as soon as reasonably possible.

  • You will not be charged for the cancelled lesson.

  • We will offer an alternative appointment wherever possible.

  • If you have already paid, the payment can be carried forward to a rearranged lesson or refunded if you prefer.

If we are late or unable to provide the full agreed lesson time, we will make up the lost time or provide an appropriate credit or refund.

We cannot ordinarily cover additional costs arising from circumstances outside our reasonable control, although this does not affect any legal rights you may have.

7. Your Responsibilities as a Learner Driver

To take driving lessons with Lightning Learners, you must:

  • Hold a valid provisional or other appropriate driving licence that legally entitles you to drive in the UK.

  • Meet the minimum legal age and eyesight requirements.

  • Inform us of any medical condition, medication or change in circumstances that may affect your ability or legal entitlement to drive.

  • Wear suitable footwear and clothing that allow you to operate the vehicle safely.

  • Follow your instructor's safety guidance and instructions.

You must not attend lessons while under the influence of alcohol, illegal drugs or anything that makes you unfit to drive.

Your instructor may refuse to start or may end a lesson where they reasonably believe it would be unsafe or unlawful to continue.

If a lesson cannot proceed because you have not met these requirements, our cancellation policy may apply, subject to the circumstances and any genuine loss incurred.

8. Driving Tests & Use of Our Vehicle

We want every pupil to feel properly prepared before taking their practical driving test.

  • Your instructor will regularly discuss your progress and readiness for your test.

  • Please discuss possible test dates with us before making a booking if you wish to use the Lightning Learners vehicle.

  • Use of our vehicle for a practical driving test must be agreed in advance and is subject to availability.

  • The price and duration of any test-day booking will be confirmed before you commit.

  • Pupils are responsible for booking and managing their own practical driving tests through the DVSA.

  • Your instructor reserves the right to decline use of the vehicle for a test where there are reasonable concerns about safety, driving standard or legal requirements.

Where concerns arise, we will discuss them with you as early as reasonably possible and aim to avoid unnecessary loss of a test fee.

The DVSA has its own cancellation and rearrangement rules. For car driving tests, at least 10 full working days' notice is normally required to change or cancel without losing the test fee, subject to DVSA exceptions.

We cannot guarantee that a pupil will pass their driving test, and we are not responsible for decisions made by the DVSA or its examiners.

If the DVSA cancels your test, we will do our best to help rearrange the time or use the reserved appointment for driving tuition where practical.

9. Prepaid Lessons, Packages & Refunds

Where lessons are purchased in advance:

  • Payments will be recorded against your pupil account.

  • The cost of lessons completed will be deducted from your balance.

  • If you decide to stop learning with us, you may request a refund for unused lessons.

  • Refunds will normally be based on the value of tuition not yet provided, less any valid outstanding lesson fees or cancellation charges.

  • If a discounted package was purchased subject to clearly communicated minimum booking conditions, any applicable adjustment will be explained when calculating the refund.

We will not retain payments for lessons we have not provided except where a lawful and reasonable deduction applies.

Any applicable statutory cooling-off rights for bookings made online, by telephone or away from our business premises will be respected.

Where such a right applies, it will not be overridden by the standard 48-hour cancellation policy. If you expressly ask us to begin tuition during a statutory cancellation period, you may be required to pay for services already supplied, as permitted by law. We will explain any necessary arrangements when you book.

10. Learning Progress & Safety

Every pupil learns at their own pace.

We will provide professional tuition suited to your experience, ability and learning needs.

We encourage pupils to take an active role in their development by discussing their progress, reflecting on lessons and agreeing goals for future improvement.

Your instructor remains responsible for managing the safety of the lesson and may intervene or take control of the vehicle whenever reasonably necessary.

We cannot guarantee a particular number of lessons will be required before reaching driving test standard.

11. Privacy & Lesson Records

We take the privacy of our pupils seriously.

We may keep relevant records of lesson bookings, payments, driving progress, learning goals and feedback using appropriate business and pupil-management systems.

Where audio recording is used to support lesson feedback or planning, we will explain this in advance, including how the recordings are handled, and obtain consent where required.

Personal information will be handled in accordance with applicable data protection legislation and our Privacy Policy, which provides further information about how data is used, stored and protected.

12. Complaints & Concerns

We want every pupil to enjoy a positive learning experience.

If you are unhappy with any aspect of your lessons or our service, please raise your concerns with us directly.

We will listen, investigate any concerns fairly and aim to resolve matters promptly.

If a complaint cannot be resolved directly, you may seek independent consumer advice or contact the DVSA where the matter relates to an instructor's professional conduct.

13. Liability & Your Consumer Rights

We will provide driving instruction with reasonable care and skill.

Nothing in these Terms & Conditions excludes or restricts our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot legally be excluded.

Nothing in these terms affects your statutory rights under UK consumer protection legislation.

Any terms found to be unenforceable will not affect the remainder of these Terms & Conditions.

These terms are governed by the laws of England and Wales, subject to applicable consumer rights.

14. Changes to These Terms

We may update these Terms & Conditions from time to time.

The latest version will be available on our website. Material changes affecting existing bookings will be communicated in advance and will not be imposed retrospectively without appropriate agreement.
